TERMS OF USE – Cirque Mobile

These Terms of Use ("Terms") govern your access to and use of Cirque Mobile, a location-based social media app that encourages local creativity and authentic expression. By accessing or using Cirque Mobile, you agree to be bound by these Terms.

1. Interpretation and Definitions

• Application refers to Cirque Mobile, the mobile app provided by Cirque Media LLC.
• Service means the features, content, and functionality made available through the app.
• You means the individual accessing or using the Service.
• Company, we, or us refers to Cirque Media LLC.
• Content refers to user-generated images, text, videos, and interactions.
• Application Store means Apple App Store or Google Play.

2. Acceptance of Terms

By using Cirque Mobile, you confirm that you are at least 18 years old and agree to these Terms. If you do not agree, do not use the Service. You also agree to our Privacy Policy.

3. User Accounts

Accounts may be created using email and password (via Firebase Authentication). Apple and Google sign-in may also be offered. Users may provide a profile photo, username, full name, and short bio. You are responsible for your account security and may delete your account at any time.

4. User Content, Posting, and Automatic Removal of Posts

• Drops (free posts): Expire after 7 days unless extended by engagement.
• Gigs (event posts): Expire after the event date.
• Spots (ads/promotions): Expire unless renewed.

You are solely responsible for any content you upload or share via the Service. By posting content, you affirm that you own or have the necessary licenses, rights, consents, and permissions to publish such content. You agree not to post content that is illegal, pornographic, defamatory, infringing, or that promotes hate or violence. We reserve the right to remove any content at our sole discretion and to suspend or terminate accounts involved in violations.

5. Moderation and Community Tools

Users may report, mute, or block others. Content may be removed automatically based on reports or violations.

6. Location-Based Functionality

Posts include a fuzzed GIS coordinate (~1/4 mile radius). This data enables location-based filtering but does not track or expose users. Disabling location access may reduce functionality.

7. Follows, Blocking, and Mutes

Users may follow, block, or mute others to control interaction and content visibility.

8. Monetization (Planned)

• Paid post visibility
• Additional Drops
• Premium subscriptions

All payments for premium features, paid post types, or subscriptions will be processed securely through the respective application store (e.g., Apple App Store). We do not collect or store any payment information. Refunds, if issued, are handled solely by the application store and may result in revocation of access to related premium content or features.

9. Prohibited Uses

You agree not to:

• Use the app for spamming, phishing, or solicitation
• Attempt to reverse-engineer, exploit, or abuse the Service
• Upload viruses or malicious code
• Impersonate others or misrepresent your affiliation
• Interfere with normal operation or bypass moderation systems

We reserve the right to investigate and take appropriate action, including legal recourse or account termination.

10. Termination

We may suspend or terminate your access without notice if you violate these Terms.

11. Limitation of Liability

We are not liable for user interactions, lost content, or technical issues. Total liability is capped at $100 or the amount you have paid.

12. “As-Is” Disclaimer

The Service is provided "as is" with no guarantees.

13. Governing Law

These Terms are governed by the laws of Wyoming, USA. You agree that any disputes arising out of or relating to these Terms shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, if required by applicable law.

14. Changes to These Terms

We may revise these Terms. Continued use means acceptance.
