Terms of Use

These Terms of Use ("Terms") govern your access to and use of Cirque Mobile, a location-based social media application developed by Cirque Media LLC. By accessing or using Cirque Mobile in any way, including browsing or creating an account, you agree to be bound by these Terms and our Privacy Policy.

1. Eligibility

You must be at least 18 years old to use Cirque Mobile. If you are under 18, do not use this Service.

2. User Accounts

You are responsible for safeguarding your account credentials. You may delete your account at any time through in-app settings. This process is available entirely within the app and does not require contacting support.

3. Your Content

You retain ownership of content you upload. By posting content, you grant Cirque Media LLC a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute your content solely in connection with the operation and promotion of the Service. You may not post content that violates any law or infringes on any third party's rights.

4. Content Expiration

• Drops: expire after 7 days unless extended by engagement.
• Gigs: expire automatically after the event.
• Spots: remain visible for the paid duration only.

5. Content Moderation & Community Safety

Cirque is committed to maintaining a safe and respectful community environment for all users. We have implemented comprehensive content moderation policies and user safety tools to ensure platform integrity.

5.1 Content Standards

Users must not post content that:

• Violates any applicable laws or regulations
• Contains hate speech, harassment, or bullying
• Contains pornographic content or extreme violence/graphic gore
• Promotes illegal activities or substance abuse
• Infringes on intellectual property rights
• Contains spam, misleading information, or fraudulent content

5.2 User Safety Tools

We provide multiple tools to help users control their experience:

• Block: Permanently prevent mutual visibility - blocked users cannot see your content or interact with you, and you will not see their content
• Snooze: Temporarily hide content from specific users for 30 days without notifying them
• Report: Flag inappropriate content or users for review by our moderation team

5.3 Reporting & Response Commitment

• Users can report inappropriate content through the post menu or user profiles
• We commit to reviewing all reported content within 24 hours
• We will take appropriate action within 24 hours. In cases of severe violations, action may be taken immediately without prior notice. Actions include:
  • Removing violating content from the platform
  • Issuing warnings to users who violate community guidelines
  • Suspending user accounts for repeated violations
  • Permanently banning users for serious or repeated violations
• Administrators may also take discretionary action to hide content or suspend accounts based on community standards, even without user reports

5.4 Automated Content Moderation

• Posts that receive 5 or more reports will be automatically hidden from public view pending review
• Hidden posts are not deleted and can be restored by administrators if reports are determined to be false
• Users may be notified when their content is reported or hidden, depending on the severity or recurrence of reports
• All automated actions are subject to human review and appeal

5.5 Enforcement Actions

Depending on the severity and frequency of violations, we may:

• Remove individual posts or comments
• Issue formal warnings to users
• Temporarily suspend user accounts (duration varies based on violation severity) or indefinitely suspend accounts for serious violations
• Permanently ban users from the platform
• Report serious violations to appropriate authorities

5.6 Appeals Process

Users who believe their content was incorrectly removed or their account was unjustly suspended may contact us at support@cirque.media for review.

5.7 Proactive Moderation

In addition to user reports, we reserve the right to proactively monitor and moderate content to maintain community standards and platform safety.

6. Location Use

GIS coordinates are saved with posts for location-based filtering. These are fuzzed (~1/4 mile), not tied to your identity, and never shared publicly.

7. Payments

All purchases are handled by Apple or Google. Cirque Mobile does not store payment data. Refunds are subject to the app store's terms.

8. Intellectual Property

Cirque Media LLC retains all rights to the app's design, features, branding, and technology.

9. Termination

We may suspend or terminate your access to the app if you violate these Terms or misuse the platform. During suspension, you will be unable to access your account or use any app features. Suspended users will receive clear notification of their status and instructions for appeals.

10. Disclaimer of Warranties

The Service is provided "as is." We make no guarantees regarding reliability or availability.

11. Limitation of Liability

To the maximum extent permitted by law, Cirque Media LLC shall not be liable for indirect, incidental, or consequential damages. Our total liability is limited to the amount paid through the app, if any, or $100, whichever is less.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Wyoming, without regard to its conflict of law provisions.

13. Changes to These Terms

We may update these Terms at any time. Continued use of the Service after any change constitutes your acceptance of the updated Terms.
